UAE to implement ‘Midday Break’ starting today

The Ministry of Human Resources and Emiratisation (MoHRE) is all set to initiate the enforcement of the ‘Midday Break’ until 15th September 2023. The Midday Break is a step from UAE government in establishing compassionate and favourable work atmosphere, keeping wellbeing of workers at centre. The period starts from today, June 15, 2023.

During this period, engaging in any work related activities in open areas or under the sunlight will be prohibited between 12:30 pm and 3:00 pm. Moreover, the decision restricts the daily working hours to eight. If an employee is required to work beyond eight hours within a 24-hour period, the additional hours will be categorised as overtime, entitling the employee to extra compensation.

Furthermore, employers must furnish workers with parasols to shield them from direct sunlight, offer shaded resting areas during breaks, and equip the workplace with suitable cooling devices like fans. Additionally, they are required to provide ample drinking water and other amenities to ensure a comfortable working environment.

The concept (Midday Break) not only recognises the need to maintain the continuity of certain jobs but also acknowledges the significant impact it could have on the community as a whole. In order to address technical constraints, certain occupations that necessitate uninterrupted work are exempt from implementing the decision. These include tasks like laying asphalt or pouring concrete, where it may not be viable to postpone these activities until after the break.

Additionally, exemptions for the Midday Break also encompass activities aimed at addressing hazards or repairing damages, such as incidents affecting water and electricity supply, and significant traffic disruptions. Moreover, projects that necessitate a permit from the appropriate government entity due to their impact on traffic flow and services are also exempted as they involve ongoing work like the modification or redirection of major traffic routes, power lines, and communication systems.
