Quite often, employers who, at the time of appointing a candidate, promise an increment after a specific duration of service, fail to grant that hike when the time comes. Employees in the UAE who are at the receiving end of such a treatment can now seek help.
As per the provisions of Cabinet Resolution No. 1 of 2022 on the Implementation of Federal Decree-Law No. 33 of 2021 regarding the Regulation of Employment Relations, an employee who is denied an increment as was promised at the time of joining a company needs to be aware that UAE labour law makes it mandatory for employers to “fulfill employment contract, employment law and ministerial resolutions”.
That means, the employment contract may not guarantee a pay hike in the future. However, if the contract does mention a pay hike on completing a specific period of service, the employee cannot be denied the same, says Khaleej Times. If that happens, the deprived employee can approach the Ministry of Human Resources & Emiratisation (MoHRE) and register a complaint.
In case MoHRE is unable to do the needful to handle the issue, the employee can then approach the court and take the legal course.
