Jharkhand High Court has ruled in favour of a retired employee seeking a pay scale upgrade under the MACP scheme, highlighting the importance of timely communication and procedural fairness.
On December 27, 2023, the Jharkhand High Court issued a significant judgment upholding a retiree’s claim to a pay upgrade under the modified assured career progression scheme (MACPS). While acknowledging the presence of negative feedback in the employee’s performance record, the court emphasised the crucial role of prompt communication and fair procedures in employee evaluation.
The dispute stemmed from the petitioner’s (represented by Advocate Prabhat Kumar Sinha) petition challenging the tribunal’s dismissal of their claim for the third MACPS upgrade. The petitioner argued that although eligible, they were denied the benefits due to a negative remark in their appraisal from 2007-08, only communicated seven years later in 2015.
The High Court (Justices Sujit Narayan Prasad and Navneet Kumar) acknowledged the similarity between criteria for pay upgrades and regular promotions. Importantly, the court emphasised that the case focused on procedural fairness, not punitive measures. The delay in communicating the negative feedback, which significantly impacted the petitioner’s claim, formed the core of the court’s criticism.
Firstly, the court condemned the seven-year silence on the negative remark, highlighting negligence on the part of the authorities. Such delay, the court argued, effectively deprived the petitioner of the opportunity to address the feedback or improve their performance.
Secondly, the court invoked the principle of “no one should benefit from their own wrong,” applying it to the authorities’ negligence. Their failure to promptly communicate the negative comment, the court reasoned, should not unjustly disadvantage the petitioner.
Therefore, the court ruled that any decisions or communications made after the delayed negative feedback cannot be considered adverse to the petitioner’s 3rd MACP claim. Consequently, the tribunal’s earlier decision denying the benefits was deemed erroneous.
