US court removes $100K H-1B fee in relief for skilled workers

Judge rules Trump-era charge was illegal, allowing workers to apply for US jobs without the hefty cost

A US federal court has struck down the $100,000 H-1B visa fee laid down by the Trump administration. This brings relief to thousands of skilled workers who rely on the programme to work in the US.

The US government introduced the levy through an executive order, arguing it would protect American jobs. The court, however, ruled that the charge amounted to an unlawful tax, which only Congress has the power to impose. The decision removes a six-figure barrier that had made the H-1B route unaffordable for many applicants and employers.

The impact was immediate. Following the announcement of the fee, H-1B applications fell sharply to just 85 petitions, compared with thousands in previous years. Several employers placed job offers on hold or withdrew them, citing financial risk. Some firms paused recruitment of foreign talent altogether.

For many professionals in technology, healthcare, engineering and other sectors facing skills shortages, the H-1B visa is the main route to build a career in the US. Critics think the fee did not address underlying labour issues but instead blocked qualified candidates from contributing to the American economy.

With the fee now quashed, the standard H-1B application process resumes. Employers can proceed with hiring plans, and overseas workers can pursue opportunities without the threat of an arbitrary expense.

While the ruling does not end the wider debate on immigration policy, it keeps the door open for skilled employees and the companies that depend on their expertise to support growth.
