The Dubai Civil Court has mandated a company to compensate one of its employees with Dh2,00,000 (equaling Rs 45,21,239.60), for accusing him of fabricating his contract papers to inflate his benefits.
This ruling stems from a lawsuit initiated by the employee against his former employer, seeking Dh5,00,000 in damages. He claimed that the company falsely accused him. Consequently, this turned into a travel ban that prevented him from visiting his ailing mother and attending her funeral in his home country.
In response to this lawsuit, the company alleged that the employee tampered with his employment contract, raising his basic salary to Dh20,000 from Dh5,000.
After considering claims from both the sides thoroughly, the Criminal Court acquitted the employee, deeming the company’s complaint malicious and aimed at coercing him to relinquish his labour rights. The court went on to order the company to compensate him with Dh2,00,000. Additionally, the court ordered a plus five per cent legal interest, as well as coverage of all expenses and legal fees.
The court recognised the employee’s financial and emotional hardships caused by the company’s actions. This also includes enduring a nine-month travel ban that prevented him from seeing his sick mother before her passing. Additionally, he struggled to secure employment due to the pending criminal case against him.
