Government employees not automatically entitled to extra pay for Saturdays: HC

The Punjab and Haryana High Court has clarified that government employees cannot assume a right to extra compensation for working on Saturdays. The Court dismissed 511 petitions from employees seeking additional wages for Saturday work, emphasising that such claims are not automatic but depend on individual service rules.
In a detailed 414-page ruling, the Court reviewed the applicability of the Sirhind case precedent, which addressed the issue of extra wages for working on Saturdays.
The Sirhind case was another landmark decision by the Supreme Court of India in 2000, which addressed issues related to pay and working conditions for government employees. The case specifically involved the interpretation of service rules concerning the entitlement of additional wages for employees required to work on Saturdays and holidays. The case involved two groups of employees: those working office hours with weekends off and those working field duties, who did not receive extra pay for weekends. The Supreme Court had ruled that these employees, though working under similar service rules, should not be treated differently based on their duties.
The Court highlighted that many employees had misunderstood the Sirhind case, incorrectly assuming it applied universally to all government workers. He pointed out that many petitions lacked detailed information about service conditions and applicable rules, which are essential for determining wage entitlement.
The judgment noted that the entitlement to additional compensation must be determined based on service conditions and rules specific to each employee, rather than a blanket application of the Sirhind case principles.
The Court ruled that claims for extra wages must be proven through appropriate legal proceedings, and employees are advised to first establish their entitlement before seeking compensation through the Labour Court or Industrial Tribunal. The Court directed that any such applications should be filed with comprehensive details and will be reviewed expeditiously, preferably within one year.
