The Central Administrative Tribunal (CAT) in Srinagar has ordered the release of provisional pension for a former employee of the Cooperative Department. The former employee known as Syed Ashaq Hussain, was compulsorily retired in December 2021. Hussain had appealed to the Tribunal for assistance in securing his provisional pension under Regulation 168-D of the Jammu and Kashmir Civil Services Regulations (CSR).
The CAT bench directed the authorities to process and release the pension within a two-month period. This order set aside an earlier directive from the Director of Finance in the Cooperative Department. The previous directive had stated that Hussain’s suspension period, from September 2020 to December 2021, required formal review by a competent authority before his pension could be processed.
The Tribunal’s order referenced a similar case involving another Cooperative Department employee, who had been granted provisional pension under the same regulation. This decision emphasises the Tribunal’s support for equitable treatment, directing officials to handle Hussain’s pension request in line with precedents set for comparable cases.
The Tribunal’s ruling is anticipated to expedite the pension release, providing Hussain with necessary financial support. It upholds principles of fair and consistent application of administrative policies across the department.
