‘Retaliation cannot override company policies’: Court

Bengaluru court awards record damages to ex employee of Willis Towers Watson India Insurance Brokers, strengthening whistleblower protection in private employment

A Bengaluru Civil Court has delivered a landmark ruling in favour of a former senior employee of Willis Towers Watson India Insurance Brokers, declaring his 2018 termination unlawful and retaliatory. According to LiveLaw, the employee, who had raised concerns about financial irregularities, was suspended and later terminated despite the company finding no conclusive evidence against him. The court noted the suspicious timing of his reinstatement followed immediately by dismissal, linking it to his whistleblowing disclosures.

The judgment awarded him nearly Rs 3.68 crore in special damages for loss of income, along with Rs10 lakh for mental anguish and additional compensation for injury to professional reputation. The court also directed the company to issue a fresh, dignified relieving letter free of stigma and remove prior suspension records. Importantly, the ruling clarified that contractual notice provisions cannot be used to bypass non retaliation policies, which are binding on employers.

Beyond compensation, the court ordered perjury complaints against two senior executives for false testimony and deliberate concealment of facts. It also highlighted that whistleblower protections are not symbolic but enforceable, and that retaliation undermines both employee trust and organisational integrity.

For HR leaders, the case underscores the importance of treating whistleblower policies as binding commitments, not decorative documents. It reinforces that protecting employees who raise concerns is essential for ethical governance, and that retaliation carries significant legal and reputational risks.
