Mumbai TCS case highlights growing pushback against forced resignations

As more employees become aware of their legal rights, such cases are expected to further shape conversations around accountability & humane HR practices

A recent case involving a Mumbai-based employee of Tata Consultancy Services (TCS) has placed a fresh spotlight on employee rights, the misuse of internal policies, and the increasing willingness of workers to challenge unfair practices. The issue surfaced widely after an employee sought help from the Labour Office when TCS allegedly refused to release his gratuity.

The employee, who had completed seven years at the company, was reportedly compelled to resign while he was attending to his father in the ICU—despite having adequate leave balance.

What began as an individual grievance soon evolved into a broader reminder of the protections available to employees under labour laws. After the complaint was filed, the Mumbai Labour Office summoned the company’s representatives to explain the circumstances under which the resignation was obtained. Officials cautioned the firm against engaging in practices that could be classified as coercive or unfair, reinforcing that even large organisations must adhere to statutory guidelines.

The intervention proved effective. The employee was eventually paid his complete gratuity for the entire duration of service. The case, amplified by the Forum for IT Employees (FITE), underscores a significant takeaway for the workforce: labour authorities have the jurisdiction to question corporate decisions, including forced resignations, layoffs and withheld payments.

The outcome serves as a strong reminder that employees are not powerless when confronted with questionable HR actions. Reporting issues, maintaining documentation, and approaching the appropriate labour authorities can lead to fair resolutions, even when dealing with major corporations. As more employees become aware of their legal rights, such cases are expected to further shape conversations around accountability, humane HR practices, and the importance of raising concerns rather than silently accepting unfair treatment.
