China court: AI adoption can’t be used to cut jobs

Chinese courts have delivered a strong message to companies embracing artificial intelligence. Adopting AI cannot be used as a legal reason to dismiss or sideline employees. A recent ruling by the Hangzhou Intermediate People’s Court has put this stance in sharp focus.

The case involved a senior tech employee who was pushed into a demotion with a steep salary reduction after his company introduced AI systems. The court ruled in his favour. It clarified that efficiency gains from automation do not qualify as a major change in circumstances under labour law. In simple terms, companies cannot cite AI adoption as grounds to alter contracts unfairly or force exits.

This decision builds on an earlier judgment by courts in Beijing, where a worker whose role was replaced by automation was also protected. Together, these rulings establish a clear legal direction. Automation is considered a business choice, not an uncontrollable external disruption.

The courts have also outlined what companies must do instead. Employers are expected to engage with workers before making changes. This includes offering retraining, exploring redeployment, or negotiating new roles. Sudden job cuts or pay reductions linked to AI are unlikely to stand legal scrutiny.

The implications go beyond China’s borders. As a global manufacturing hub for electronics, the country plays a central role in producing devices used worldwide. Higher compliance requirements could increase operational costs for companies relying on automation to cut expenses.

For businesses, this signals a shift towards more responsible AI adoption. For workers, it offers reassurance that technological change does not automatically mean job loss. The rulings suggest a future where innovation and workforce protection must move together, not at odds.
